Man shot by Starbucks customer charged with aggravated assault, criminal trespass

(KUTV) -- Benjamin Scott Overall, 37, was charged with third degree felony aggravated assault and a misdemeanor charge for criminal trespass in regards to an incident at Starbucks last week.

Overall suffered a gunshot wound by a Starbucks customer who claimed he went after him and shot the firearm in the name of self defense.

That shooting occurred just after 6 a.m. at 3898 South and 900 East, Oct. 4, following a panic alarm at nearby 7-Eleven store.

An officer responded to the alarm and came in contact with Overall, who had refused to leave the 7-Eleven. Overall then fled to the Starbucks

Court documents stated that a Starbucks employee was bent down behind the counter and when she stood up, Overall was also behind the counter and puncher her on the left side of her head.

She attempted to escape, but Overall kept throwing punches at her, hitting her in the head, neck and shoulders, the probable causes statement said.

At one point, Overall is accused of grabbing a metal basket off of the counter and began hitting the Starbucks employee with it, kicking and stomping on her once she fell to the floor, the documents say.

After Overall finished assaulting the employee, he aggressively went after a store customer who shot him in the chest. Overall is still recovering in the hospital from that wound.
